This website, kitchuan.com (the "Site"), is operated by Hong Kong Star Ocean Holdings Limited, trading as Kitchuan ("Kitchuan", "we", "us"). By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), including the policies referenced here (Refund policy, Shipping policy and Privacy policy). Please read them carefully. If you do not agree, do not use the Site.

1. Online store terms

You confirm that you are at least the age of majority in your state or province of residence, and that you will not use our products for any illegal or unauthorized purpose. A breach of any of these Terms may result in the immediate cancellation of your order or account.

2. General conditions

We reserve the right to refuse service to anyone for any reason at any time. Your content (excluding payment card information) may be transferred unencrypted over various networks as part of normal operation; payment card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell or exploit any portion of the Site without our written permission.

3. Accuracy of information

We do our best to keep product descriptions, images, pricing and availability accurate, but we do not guarantee that all content on the Site is complete, current or error-free. We may correct errors and change or update information at any time without notice, including after you have submitted an order.

4. Products and pricing

All prices are in US dollars unless stated otherwise. Prices and product availability may change without notice. Colors and finishes may appear slightly different depending on your screen. We may limit quantities per person, per household or per order, and we may discontinue any product at any time.

5. Orders and payment

By placing an order you agree to provide current, complete and accurate purchase and account information. We may refuse or cancel any order, including orders that appear to be placed by dealers or resellers without a wholesale agreement, and we will notify you by email if we do. Payment is collected at checkout through Shopify Payments, PayPal or the other methods shown at checkout.

6. Shipping, returns and refunds

Shipping is governed by our Shipping policy and returns by our Refund policy, both of which form part of these Terms.

7. Wholesale and bulk orders

Wholesale orders are subject to the quantities, prices, lead times and freight terms set out in the written quote and order confirmation, which take precedence over these Terms where they differ.

8. Intellectual property

The Kitchuan name, logo, product designs, photographs and all content on the Site are owned by or licensed to Hong Kong Star Ocean Holdings Limited and are protected by applicable intellectual property laws. You may not use them without our prior written consent.

9. Reviews and submissions

If you send us reviews, comments, suggestions or other material, you grant us a non-exclusive, royalty-free, perpetual licence to use, edit and publish it in any medium. You are responsible for the accuracy of anything you submit and confirm it does not infringe the rights of any third party.

10. Personal information

Your submission of personal information through the Site is governed by our Privacy policy.

11. Third-party links and tools

The Site may include links to third-party websites or tools. We are not responsible for their content, accuracy or practices, and your use of them is at your own risk.

Where applicable law does not allow this limitation, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits any consumer rights that cannot be excluded under the law of your state or province.

15. Indemnification

You agree to indemnify and hold harmless Kitchuan and its affiliates, officers, employees and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

16. Severability

If any provision of these Terms is found to be unlawful or unenforceable, it will be enforced to the fullest extent permitted by law and the remaining provisions will remain in full force.

17. Termination

These Terms are effective unless and until terminated by you or by us. We may terminate this agreement at any time if you fail, or we suspect you have failed, to comply with any provision, and you will remain liable for all amounts due up to the date of termination.

18. Entire agreement

These Terms and the policies referenced here constitute the entire agreement between you and us regarding the Site and supersede any prior agreements or communications.

19. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without affecting any mandatory consumer-protection rights you have under the laws of the state or province where you live.

20. Changes to these Terms

We may update these Terms at any time by posting the updated version on this page. Continued use of the Site after changes are posted constitutes acceptance of those changes.
